This includes all the Platform’s information, communication, software, scripting, photos, texts, videos, graphics, music, sounds, images, other materials and services (collectively ‘Content’). Our Content is provided as a form of convenience for its online visitors, customers, employees and the public.

Acceptance of contract terms: Jurisdiction

In exchange for accessing, browsing and/or using the Website, you agree to be bound by these terms and to comply with all Applicable laws and regulations, including without limitation UAE Federal Law No. 40 of 1992 concerning the Protection of the Intellectual Work and Rights of the Author and the Implementing Regulations thereof. The Website can only be used by persons who can form legally binding contracts under Applicable law. The Website can only be used by natural persons who are not minors or under the age of 18 years and who can form legally binding contracts under applicable law. Minors or people under the age of 18 years shall not register as a User of the website and shall not transact on or use the Website. Funzone.ae reserves the right to terminate your registration and refuse to provide you with access to the Website if Funzone.ae discovers that you are incompetent to contract under Applicable laws. The Website cannot be accessed by persons whose registration has been suspended or terminated by Funzone.ae for any reason whatsoever. 

Membership Eligibility

Funzone.ae reserves the right to terminate your membership and refuse to provide you with access to the Site if Funzone.ae discovers that you are under the age of 18 years or otherwise not capable of forming binding contracts. Unless otherwise specified, the materials on this website are directed solely at those who access this website from UAE. Funzone.ae makes no representation that any products or services referred to in the materials on this website are appropriate for use, or available outside UAE. 

Those who choose to access this Site from outside UAE are responsible for compliance with local laws if and to the extent local laws are applicable. Funzone.ae will deliver the products only within UAE and will not be liable for any claims relating to any products ordered from outside UAE.

Unless otherwise stated in writing as additional terms and conditions which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of Funzone.ae you agree to be bound by the Terms and Conditions.

Modifications

Funzone.ae reserves the right at all times to discontinue or modify the Terms of Use and/or our Privacy Policy as we deem necessary or desirable without any prior notification. Such changes may include, among other things, the adding of certain fees and charges. Any such modifications would be effective immediately. We suggest that you read our Terms and Conditions and Privacy policy from time to time to stay informed. Any use of the site after such modifications would be deemed to constitute acceptance of the modified terms by the End User.

Account and Registration

It is the user's responsibility to keep the details of the account and password confidential and you agree to accept responsibility for all activities that occur under Your Account or Password. Funzone.ae shall not be liable to any person for any loss or damage which may arise as a result of any failure by the user to protect the account details or the password. In case of any suspected breach please contact us immediately. If Funzone.ae has reason to believe that there is likely to be a breach of security or misuse of the Funzone.ae Site, we may require you to change your password or we may suspend your account without any liability to Funzone.ae.

You also agree to

• Provide true, accurate, current and complete information about yourself as prompted by Funzone.ae website during the registration process (such information being the "Registration Data")
• Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current, if Funzone.ae has reasonable grounds to suspect that such information is untrue, inaccurate, not current or not in accordance with the User Agreement, or if in the opinion of Funzone.ae your use of the Website breaches the terms of the applicable law, or the rights of any person, or is detrimental in any way to Funzone.ae, Funzone.ae will have the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

Contract terms

All products/services and information displayed on this site, constitute an "invitation to offer". Our “acceptance” of your order will take place upon dispatch of the product(s) ordered for home delivery orders or after you pick up the product(s) for Click & Collect orders. We strive to ensure the accuracy of the product and pricing information within the website, however there may be pricing or typographical errors. In such an event where a product is listed at an incorrect price or with incorrect information, Funzone.ae has the right, at our sole discretion, to refuse or cancel any orders placed for that product up until dispatch for any reason. You agree to pay the full amount payable for the Product as indicated during the order process, including any shipping costs or charges incurred with that order. In the event that a non-delivery occurs on account of wrong name or address or any other wrong information entered by you, the extra cost incurred for redelivery shall be claimed from you.

All transactions are conducted in the local currency of the market where products are sold. When using a credit card supplied by banks other than those in that local market, the amount on the credit card (or debit card) bill may differ due to exchange rate fluctuations and any charges that the card issuer/bank may have debited and you agree that we shall have no liability for such price fluctuations or charges. In the event of Value Added Tax (VAT) being levied or introduced by government authorities in a jurisdiction where products are sold or where Funzone.ae is incorporated and/or a tax resident, Funzone.ae reserves the right to charge VAT at the prevailing VAT rate (as applicable) in respect of any supply of products or services. You shall pay the amount of any such VAT as an addition to the invoice value. 

VAT terms

Effective 1 Jan, 2018, the UAE Government has introduced Value Added Tax (VAT) at a standard rate of 5%. Funzone.ae with this mandate and VAT is applicable to most goods and services, including our delivery, Installation and warranty charges. All prices and services on the website are inclusive of VAT. For all orders, customers are provided with tax invoices. Customers can also request for their tax invoice by calling Customer Support. TRANSACTIONS & CANCELLATION

Credit Card Details

You hereby agree, understand represent and warrant that the credit card details provided by you for availing of services on website are correct, accurate and current and that you are lawfully authorized to provide us the details and use such credit card to make purchases on the Website. You further agree and undertake to provide the correct and valid credit card details to us. The card details will not be utilised and shared by us with any of the third parties unless required for fraud verifications or by law, regulation or court order. We will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove it otherwise' shall be exclusively on you.

Cancellations by the Customer

In case we receive a cancellation notice and the order has not been shipped by us, we shall cancel the order and refund you the entire amount. The orders that have already been shipped out by us will not be cancelled and you will have to check our return policy on those orders.

Cancellation by Funzone.ae

Under certain circumstances it might not be possible for us to accept an order and we may be compelled to cancel the same. We reserve the right to refuse or cancel any order for any reason at our sole discretion. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also ask for additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. We will not be liable for any cancellations and you agree not to dispute the decision made by us and accept our decision regarding the cancellation.

Payment

While availing any of the payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to:

• lack of authorization for any transaction/s,
• or exceeding the preset limit mutually agreed by you and between your "Bank/s",
• or any payment issues arising out of the transaction,
• or decline of transaction for any other reason/s.

All payments made against the purchases/services on Funzone.ae by you shall be compulsorily in AED. Funzone.ae does not accept any other form of currency with respect to the purchases.

Before shipping your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.
